AI offers enormous possibilities, but it comes with responsibility. As a business owner, you need to know the rules—not to hold yourself back, but to protect your business and your customers.
GDPR and AI: The Key Rules
When you use AI tools like ChatGPT, you're sending data to an external service. If that data contains personal information (customer names, emails, purchase history), it's governed by GDPR.
The main rule: Never upload personal data to AI tools without a data processing agreement in place. Most free versions of ChatGPT, Gemini, and others use your inputs for training—this conflicts with GDPR for personal data.
Use paid versions with training opt-out (ChatGPT Team/Enterprise, Claude for Business), or anonymize your data before using it. Remove names, emails, and any identifying information.
EU AI Act: What It Means for You
The EU's AI Regulation came into effect in 2024 and is being implemented gradually. For most small businesses and entrepreneurs, the direct impact is limited, as most AI uses in marketing fall into the low-risk category.
But be aware: If you're using AI to generate content, you should be transparent with your audience. And if you're using AI to make decisions that affect people (hiring, credit decisions, etc.), there are stricter requirements.
Ethical Guidelines for AI in Marketing
Transparency: Consider whether you should tell your audience that you're using AI. There's no legal requirement for marketing content, but it builds trust.
Quality Control: AI can produce incorrect information. Always fact-check, especially on professional or health-related topics.
Copyright: AI-generated text and images have a complex legal status. Never use AI output that's clearly based on others' work. And be aware that purely AI-generated content may not be copyright-protected.
Bias: AI models can reproduce prejudices from their training data. Be critical of output that seems stereotypical.
Practical Compliance Tips
Create an internal AI policy, even as a solo entrepreneur. Decide: Which AI tools do we use? What can we upload? What do we fact-check? When do we mention AI use?
Stay informed. AI regulation is a rapidly changing field. Follow your country's data protection authority guidelines and the EU's AI Office.
